The legal inventiveness of contemporary African societies has not received the attention it deserves. A widespread prejudice too often consists in presenting the rules of law as a kind of artifice condemned to oscillate between mimicry and ineffectiveness, between extroversion and disembodiment.
To counter this popular misconception, the author gives ten examples, evoking ten themes touching on major legal issues, in which Africa has created, refined, enriched, or sublimated principles or institutions. Ten examples through which, while remaining firmly within the realms of modernity, the African continent can certainly claim a kind of precedence and, perhaps, exemplarity.
Firmly rejecting any vertical or monopolistic rationale, the book is based on the conviction that the development of law takes place in a horizontal mode of osmosis, hybridisation, and polycentrism. It is an exhortation to look at what is being done elsewhere, an invitation to listen and to explore new horizons. -

Cet ouvrage traite d'un aspect juridique négligé de la théorie juridique moderne. Il ne s'intéresse ni aux aspects positifs ou factuels du droit, ni à sa lecture morale, mais à son message éthique : comment devons-nous vivre notre vie, et comment le droit nous aide-t-il à mener une bonne vie ?
Chaque personne responsable doit s'efforcer de vivre une vie de raison et de valeur, en suivant l'idéal de vie des anciens Romains, c'est-à-dire en observant la règle de honeste vivere. Utilisant les méthodes de la théorie juridique traditionnelle, l'auteur analyse ainsi les dilemmes constitutionnels les plus difficiles et en déduit les rudiments d'un droit qui peut aider ses citoyens à mener une bonne vie. L'apport le plus important et original de cette approche, centrée sur l'individu, est qu'elle dépasse la dichotomie du positivisme et du droit naturel en proposant une troisième voie.
